Any order placed on the www.saintelucie1885.fr website (hereinafter referred to as the "Site") implies the Internet user's express acceptance of these general terms and conditions of sale (hereinafter referred to as the "GTCS"). In order to keep a copy of the GSC, the following link enables the Internet user to download and print them: General terms and conditions of sale of the www.saintelucie1885.fr website.

ARTICLE 1: SCOPE OF APPLICATION

These general terms and conditions of sale apply exclusively to current and future commercial relations between Sainte Lucie, a simplified joint stock company with a share capital of €192,150.00, registered with the Compiègne Trade and Companies Register under number 572 151 207, whose registered office is located at Creil (60100) - Parc Technologique Alata 5 Rue des Chèvrefeuilles ("we") and the author of the order ("you"). They govern all the terms and conditions of distance selling of products marketed on the Site.

“Product(s)” refers to any product offered for sale on the Site, namely: spices and baking supplies; provided that the Products featured on the Site are offered for sale only within mainland France.

These terms and conditions apply to the exclusion of all other conditions, in particular those applicable to in-store sales or sales via other distribution and marketing channels.

These terms and conditions may be modified at any time. In the event of modification, the GTC in force and online on the day of the order will be applied to each order.

ARTICLE 2: ORDERING

We undertake to accept your order in accordance with these terms and conditions. When you place your order, we will inform you of the availability of the products you wish to purchase. However, if, despite our vigilance, the products prove to be temporarily unavailable (out of stock, reissue, etc.) after your order, we will inform you by e-mail and invite you to cancel or modify your order. If the products are definitively unavailable (out of stock, etc...) after your order, we will automatically cancel your order and inform you by e-mail before proceeding with the reimbursement of any sums paid for the part related to the missing products. By validating your payment, you confirm that you have read these General Terms and Conditions of Sale (GTCS) and have accepted them by ticking the appropriate box. In the absence of proof to the contrary, the data recorded in the Vendor's computer system shall prevail and constitute proof of the transaction. Confirmation of your order implies full and complete acceptance of the GCS made available on the site. You acknowledge that you are fully aware of them and waive the right to invoke any contradictory document, in particular your own general terms and conditions of purchase.

ARTICLE 3: PRICES

Prices are quoted in euros and include all taxes according to French tax rates, but exclude shipping costs. We reserve the right to modify our prices at any time. We undertake to apply the current prices indicated at the time of your order.
For orders outside the European Union, prices will be corrected by the amount of VAT when you enter your delivery address in the appropriate form. Any customs duties and taxes connected with the delivery of an item are your responsibility. We are not obliged to check and inform you of applicable customs duties and taxes. To find out, we advise you to contact the relevant authorities in your country. Under no circumstances shall we be held liable for any additional costs related to the delivery of the order, other than transport charges, which are described and invoiced when the order is placed on our site.

ARTICLE 4: PAYMENT

Payment is due immediately on the order date. Payment is made online via a secure solution provided by the Caisse d'Epargne, using the Systempay module associated with the 3D Secure protocol, guaranteeing the confidentiality and security of transmitted data.

Accepted means of payment are :

  • French and international credit cards: CB, Visa, Mastercard
  • Apple Pay
  • Google Pay

Cards issued by banks domiciled outside France must be international bank cards. Payment information is encrypted and cannot be intercepted during transmission over the network. Your order can only be processed once your payment has been accepted and this acceptance has been transmitted to our services by the Caisse d'Épargne payment platform.

ARTICLE 5: SPONSORSHIP

The Site proposes a sponsorship offer:
-10% on the amount of the basket for the sponsor and for the sponsored child, usable only once on an order.
This discount is applied via a promotional code available in the "My account" area, on the "Sponsorship" tab. The offer cannot be combined with other promotions and is reserved for orders delivered in mainland France.

ARTICLE 6: DELIVERY

Unless otherwise specified, delivery will be made to the address provided when you placed your order. We ship products exclusively to mainland France. Any order with a delivery address outside this area may be canceled or refused.

Delivery times are provided for informational purposes only, unless we have specifically committed to a specific date. Products are delivered by GLS.

In the event of non-receipt of the parcel, you have 3 weeks to make a claim.

For deliveries within mainland France:

  • For all orders under €50 including VAT:
    • €6.80 (including tax) for home delivery with signature
    • €5.50 (including tax) at a GLS pickup point

Delivery times are estimated to be between 1 and 5 business days.
Orders placed over the weekend are processed the following Monday, and orders placed on a holiday are processed the next business day.

Additional shipping fees may apply to certain destinations due to geographical access constraints, as determined by the carrier GLS. A list of the affected ZIP codes is available from your GLS representative.

The applicable surcharges are as follows:

  • Corsica: €22.83 (including tax) per package
  • Mountainous areas: €4.92 (including tax) per package

These surcharges are in addition to the shipping costs listed above and are charged per package.

If the package is not picked up within the time frame specified by the carrier or the pickup location, it will be automatically returned to us.

In that case, we offer the following solutions:

  • a refund for your order, excluding the original shipping costs
  • or the reshipment of your order, subject to prior payment of the applicable shipping fees

Any return shipping fees charged by the carrier may be deducted from the refund, if applicable.

The item will be reshipped only after we have received payment for the shipping costs via bank transfer, using the account details we will provide to you.

We cannot be held responsible if the package is not picked up within the specified time frame.

In the event of a lost package as determined by the carrier or confirmed following a carrier investigation, the Customer may choose between:

  • a refund for the value of the products listed on the order, excluding shipping costs
  • or a store credit equal to the value of the items listed on the order (excluding shipping costs), which can be used on a future order

The credit cannot be combined with any promotions or discounts the Customer may have received when placing the initial order.

The shipping charges initially billed, as well as the shipping charges applicable to a new order, remain the responsibility of the Customer and are not refundable.

Certain products offered for sale, particularly chocolates, are sensitive to temperature fluctuations. By placing an order, the customer acknowledges that they have been informed of this and agrees that delivery will be made under the standard terms and conditions set forth on the Website. We cannot be held liable for any spoilage or deterioration of products due to weather conditions (extreme heat, heat waves, etc.) if the selected shipping method does not guarantee a controlled temperature. In the event of adverse weather conditions, it is the customer’s responsibility to postpone their order or adjust their purchase accordingly.

Furthermore, we shall not be held liable for delays due to stock shortages or for errors in the presentation of products on our website, as the photographs, texts, and illustrations depicting the products are not contractually binding. Finally, we cannot be held liable for any use of the products that does not conform to their intended purpose or to the recommendations appearing on the packaging. We also cannot be held liable for any deterioration of products due to weather conditions, particularly during periods of extreme heat for sensitive products.

The brand we distribute is a registered trademark. Any reproduction, imitation, use, affixing, removal or modification of this trademark constitutes an infringement which may be punished under the same conditions. Your use of the Site does not give you any intellectual property rights over it or its content. In any case, any link not expressly authorized must be withdrawn upon simple request from us.

We each waive our right to avail ourselves of the provisions of article 1195 of the French Civil Code and the unforeseeable circumstances provided for therein. We undertake to assume our obligations even if the contractual balance is upset by circumstances unforeseeable at the time of conclusion of the sale, even if their performance proves excessively onerous, and to bear all the economic and financial consequences thereof.
